Chinese Trademark Filing Guideline
1. Trademark Registration Application:
1) Mark Sample: 6 sets for filing, including 5 color sets for a color mark;
2) Applicant information—name, nationality, and address;
3) Goods and class—International classification, and names of goods as listed in the International Classification Table;
4) Power of attorney—must be filed with the application, and shall be executed by the applicant, and a fax copy is acceptable;
5) Priority document may be filed within three months after the filing.
2. Trademark Renewal Application:
1) A copy of the registration certificate for us to ascertain the particulars;
2) Power of attorney—requirements see above.
3. Trademark Assignment:
1) An executed Assignment Agreement—signed by both parties;
2) Information of trademark registration;
3) Power of attorney—must be executed by the assignee;
4) Note: Same or similar marks shall be assigned together.
4. Trademark License:
1) A license Agreement in both English and Chinese (translation) must be executed by both parties;
2) Information of trademark registration;
3) Power of attorney—must be executed by the licenser;
4) Note: The license agreement must be recorded within three months from the execution or effective date.
5.Trademark Opposition:
1) A clip of the trademark publication or publication number and date and supporting materials—filed within three months after the publication;
2) Any supplemental materials can be filed within three months after filing;
3) Power of attorney—see above requirement.
6.Trademark Cancellation—non-use and improper registration:
1) Registration information and initial evidence of non-use of the mark;
2) Registration information and evidence of improper registration;
3) Power of attorney.
7.Trademark Search:
1) A sample of the mark;
2) Goods or class or even sub-class.
8. Change of name/address of registrant/applicant:
1) Certificate of change of (business) name and address;
2) Power of attorney
3) Note: All registrations/applications should be changed together.
